Proposed Lease Agreement with Portland RSL Sub Branch Inc. at 21 Percy St Portland
Glenelg Shire Council is proposing to replace the current trust deed for a lease with the Portland RSL Sub-Branch Incorporated. The proposal is for a period of 10 years with two five-year extensions at $1 per annum.
As the lease proposed exceeds a 10-year period, Council is required to undertake a community engagement process to allow community to help inform decision making.
Community feedback is planned to be included in a report to Council at the February 2025 Council Meeting where a decision on the lease will be finalised.
Background
A trust deed was originally sealed by Council in November 1926 relating to this property following the end of the first World War. The trust deed permits the Portland RSL to have the use, occupation and enjoyment of the land and buildings at 21 Percy Street Portland being used as Clubrooms for returned service personnel.
In recent times it was proposed to instigate a lease to replace the outdated deed provisions in order to formalise the tenure, maintenance and use of the building, and outlay the obligations of landlord and tenant.
The implementation of this lease will mean that RSL Sub Branch Inc. will have sole use of the building and that Council will be responsible for more maintenance obligations than are under the current deed.
