To provide notice to the community of Council’s intention to sell Lot 1 TP948421A. Council is inviting submissions from the community in regards to its intention.

Submissions close 5pm, Wednesday 28 August 2019.

Purpose

Council is seeking submissions from the community on its intention to sell lot 1 of TP948421A in the Parish of Portland (Volume 11290, Folio 478).

Background

The land was transferred to Council by the Australian Securities and Investments Commission (ASIC) in March 2011 but essentially forms part of the land formerly used by Claymac Ford and more recently Journey Management Group.

The size of the lot is 369 m2 and is currently included within the property parcel known as 598 Henty Highway Portland.

At the ordinary council meeting on Tuesday 23 July 2019, Council resolved to give public notice of its intention to sell the land to Tygadis Pty Ltd for $1.00 plus full recovery of all legal and associated costs relating to the sale and transfer of land.

How do I make a submission?

Any person may make a submission on Council’s proposal to sell the Land.

Section 189(2)(a) of the Act requires councils to give at least 28 days public notice before the sale or exchange of land. Further, section 189(3) of the Act provides that a person has a right to make a submission under section 223 on the proposed sale or exchange of land.

Any person requesting to be heard in support of his or her submission is entitled to be heard before Council (or its committee established by Council for this purpose), or represented by a person acting on his or her behalf.

What happens to my submission?

If required a meeting of the special committee of Council to hear submissions, will occur at 7.00 pm on Tuesday 10 September 2019 at the Glenelg Shire Council Portland Office, or if required at another day and time to be determined by the Chief Executive Officer. If there are no submissions that request to be heard, the meeting will not take place.

Where objections to the proposal are received Council will consider all submissions prior to making a decision to sell the land.

All submissions will be made publicly available, however all personal information will be removed.

People who make a submission will be notified in writing of the decision and the reasons for that decision.
